Please read these terms carefully before using Finvy.ai services. By registering an account or using our platform, you agree to be bound by these terms.

1. Service Description and Scope
Finvy.ai (hereinafter referred to as "the Platform") is developed and operated by the Finvy AI team, providing automated cryptocurrency lending management services to help users execute lending strategies on the Bitfinex exchange. The Platform's features include but are not limited to: automated lending bots, market analysis tools, strategy management, and earnings tracking. This service is solely a technical assistance tool and does not constitute any form of investment advice, financial planning, or asset management service. The Platform executes lending operations on behalf of users through their Bitfinex API keys. All funds remain in users' Bitfinex accounts at all times — the Platform does not hold, transfer, or manage any user funds.
2. Account Registration and Eligibility
You must complete the account registration process before using our services. Registration requires a valid email address and password. You must ensure that all information provided is truthful, accurate, and complete. You must be at least 18 years old or have reached the legal age of majority in your jurisdiction. Your region must permit the use of cryptocurrency-related services. Each user may only register one account. We reserve the right to refuse, suspend, or terminate any account without providing a reason.
3. User Responsibilities and Obligations
Users are responsible for maintaining account security, including protecting passwords and API keys from unauthorized third-party access. Users bear full responsibility for all activities occurring under their accounts. When setting up Bitfinex API keys, users must only grant "Read" and "Lending" permissions. Do not enable "Withdrawal" or other unnecessary permissions. The Platform is not liable for losses resulting from users granting excessive permissions. Users must not use the Platform for any illegal purposes, including but not limited to money laundering, terrorist financing, or any activities violating applicable laws and regulations. Users must comply with all applicable laws, tax obligations, and regulatory requirements in their jurisdiction.
4. Subscription Plans and Payment
The Platform offers different subscription tiers with varying features, bot limits, and pricing as detailed on the Subscription page. New users receive a 7-day free trial with full feature access. Paid subscriptions are billed on a monthly cycle, charged at the beginning of each period. We currently accept cryptocurrency as payment. You may upgrade or downgrade your subscription plan at any time. Upgrades take effect immediately with prorated billing; downgrades take effect at the end of the current billing cycle. After cancellation, service continues until the end of the current billing cycle. All payments are non-refundable once processed, unless otherwise stated in these terms or required by applicable law.
5. Risk Warning and Disclaimer
The cryptocurrency market is highly volatile, and lending operations carry inherent risks. While Bitfinex's lending mechanism includes margin protection, losses may still occur under extreme market conditions (e.g., when borrowers' margins are insufficient and positions are force-liquidated). Past performance does not guarantee future results. The Platform does not guarantee any specific investment return rate or earnings level. Market interest rates fluctuate in real-time based on supply and demand. The Platform's strategies and algorithms may fail to achieve expected results due to market conditions, technical failures, or other unforeseen factors. Users should fully understand the associated risks and only invest funds they can afford to lose. The Platform is not responsible for losses caused by: market volatility, issues or disruptions with the Bitfinex exchange itself, user operational errors, cyberattacks or security incidents, or force majeure events.
6. Service Availability and Limitations
We strive to provide stable and reliable services but do not guarantee 100% uptime or error-free operation. Services may be temporarily interrupted due to: system maintenance and updates, server failures or technical issues, Bitfinex API service disruptions, network problems, or force majeure events. We will make reasonable efforts to notify users before planned maintenance, but may not be able to provide advance notice for emergency maintenance. During service interruptions, bots may be unable to execute lending operations; previously submitted orders will not be affected.
7. Intellectual Property
All content, software, algorithms, designs, trademarks, and other intellectual property on the Platform are owned by or duly licensed to the Finvy AI team. Users receive a limited, non-exclusive, non-transferable license to use the service during their subscription period. Users may not copy, modify, reverse engineer, decompile, or otherwise attempt to obtain the Platform's source code or core algorithms. Users may not resell, sublicense, or commercially exploit any part of the Platform without prior written permission.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Finvy.ai and its team members shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from the use of or inability to use the service. This limitation applies even if the Platform has been advised of the possibility of such damages. In no event shall the Platform's total liability exceed the total subscription fees paid by the user in the 12 months preceding the occurrence of the damage. Some jurisdictions do not allow the exclusion or limitation of liability for incidental or consequential damages, so the above limitation may not apply to you. In such cases, the limitation of liability shall apply to the maximum extent permitted by applicable law.
9. Account Suspension and Termination
We reserve the right to suspend or terminate your account under the following circumstances: violation of any provision of these terms, engaging in suspicious or illegal activities, prolonged account inactivity (over 12 months), or failure to pay subscription fees. After account termination, your personal data will be handled according to our Privacy Policy. Encrypted API keys will be permanently deleted. You may request account deletion at any time through Account Settings. All associated data will be purged within 30 days of account deletion.
10. Indemnification
You agree to indemnify and hold harmless Finvy.ai and its team members, partners from any claims, losses, expenses (including reasonable attorney's fees) arising from: your violation of these terms, your use of the service, or your violation of any applicable law or third-party rights.
11. Governing Law and Dispute Resolution
These terms shall be governed by the laws of the Republic of China (Taiwan), without regard to conflict of law principles. Any disputes arising from these terms or the service shall first be resolved through amicable negotiation. If negotiation fails to reach resolution within 30 days, either party may submit the dispute to the jurisdiction of the Taipei District Court in Taiwan.
12. Terms Modification and Notice
We reserve the right to modify these terms at any time. After modification, we will notify users via email or platform announcements. Material changes will be communicated at least 14 days before taking effect. Continued use of the service constitutes acceptance of the modified terms. If you do not agree with the modified terms, you should stop using the service and delete your account. These terms were last updated on January 30, 2026.
